These Terms and Conditions ("Terms") govern your use of the Castro & Sons LLC website at https://castroandsonsllc.com and your requests for or use of our transportation and delivery services. By accessing the site or requesting services, you agree to these Terms. If you do not agree, please do not use the website or book through it.

1. About our services

Castro & Sons LLC provides non-emergency medical transportation (NEMT), livery and door-to-door taxi-style transportation, wheelchair-accessible vehicles, airport transportation, black car/sedan service, medical supply delivery, small-business and courier/last-mile delivery, and related services in and around the Hudson Valley, including Orange, Ulster, Dutchess, Putnam & Westchester County, NY. Service availability depends on vehicle capacity, scheduling, weather, road conditions, and other operational factors.

We are not an emergency medical service. For medical emergencies, call 911.

2. Website use

You may use this website to learn about our services, contact us, request fare estimates, submit booking requests, authorize or complete payment, and access payment links we provide. You agree to provide accurate information and not to misuse the site (including attempting to disrupt, scrape, or abuse booking or payment features).

3. Fare estimates

Online fare estimates are approximate and based on the trip details you enter (including addresses, date and time, vehicle type, wait time, and return ride when selected). Estimates may include mileage calculated from our dispatch location and applicable private-pay or payer/Medicaid rate logic shown on the site. Final fare may differ based on actual route, wait time, stops, accessibility needs, scheduling changes, or other factors we communicate at confirmation.

4. Bookings and confirmation

Submitting a booking request or authorizing a card does not guarantee that a ride is confirmed. We review requests and will confirm availability through our dispatch process. We may decline or cancel a booking when we cannot safely or reasonably fulfill it. You are responsible for being ready at the agreed pickup location and time, and for providing complete address and contact details.

Round-trip requests require a return pickup time. Return timing is subject to confirmation and operational constraints.

5. Payments, authorizations, and payment links

Private-pay bookings made through the website may require card authorization for the estimated fare. An authorization holds funds but does not charge you until we confirm the ride and capture payment. If we deny or cannot fulfill the booking, the hold may be released according to card network and processor rules (release timing can vary by bank).

Payment links issued by our team are for paying a quoted trip amount. Completing payment on a link generally charges the card immediately for that amount, subject to Stripe processing.

Payments are processed by Stripe. Additional processor fees, declines, or bank rules may apply. You represent that you are authorized to use the payment method provided.

Medicaid, insurance, or other payer-arranged transportation may follow different billing rules. Website estimates for payer channels are informational and do not replace plan authorization or eligibility requirements.

6. Passenger and delivery responsibilities

You agree to:

• Provide truthful trip, contact, and accessibility information
• Follow reasonable safety instructions from drivers and dispatch
• Not transport illegal items or engage in unlawful or abusive conduct
• Secure any cargo or packages for delivery services and accurately describe delivery needs

We may refuse or end service if safety, legality, or vehicle capacity is at risk.

7. Cancellations and no-shows

Please notify dispatch as soon as possible if you need to cancel or change a trip. Late cancellations, no-shows, or excessive wait time may result in charges consistent with our dispatch policies and the estimate or confirmation you received. Contact (845) 275-7575 for scheduling changes.

8. Accessibility

Wheelchair-accessible and related NEMT services depend on vehicle availability and the information you provide about mobility needs. Request accessible service when booking so we can assign an appropriate vehicle.

9. Intellectual property

Website content, branding, and materials are owned by Castro & Sons LLC or its licensors. You may not copy, modify, or redistribute site content for commercial purposes without our prior written consent.

10. Disclaimers

The website and online tools are provided on an "as is" and "as available" basis. We do not warrant uninterrupted or error-free operation of the site, mapping data, or fare calculators. Travel times are estimates only.

11. Limitation of liability

To the fullest extent permitted by law, Castro & Sons LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or services. Our total liability for any claim related to a specific trip is limited to the amount you paid us for that trip, except where liability cannot be limited under applicable law (including for gross negligence or willful misconduct where such limits are prohibited).

12. Indemnity

You agree to indemnify and hold harmless Castro & Sons LLC and its owners, employees, and agents from claims arising out of your misuse of the website, inaccurate information you provide, or your violation of these Terms or applicable law.

13. Privacy

Our collection and use of personal information is described in our Privacy Policy.

14. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes arising from these Terms or our services will be resolved in courts located in New York, unless applicable law requires otherwise.
